I commented on this draft on the gendispatch list in January:
https://mailarchive.ietf.org/arch/msg/gendispatch/jMijzjOBDyt9E_3wXW2tB7XEJKw/.
I think we do have a problem with the bullet in section 4.2 that says:

     * Seeking clarifications about IPR disclosures, in a context when
any such clarifications could be reasonably perceived as entering
into group negotiations of IPR terms.

As written, this bullet contradicts the long standing practice of
preferring technologies that are not encumbered by patents and can be
implemented freely, including in open source.

Mark Nottingham further developed the argument:
https://mailarchive.ietf.org/arch/msg/gendispatch/Ywq1S7nxBo_PsqjaMZMGT_78w0Y/

I would be nice to see this point addressed in the revised draft.
