Greetings, Attached is a note I sent to ISOC. The "good news" part is that this letter of intent is from a corporate officer, as opposed to their patent counsel! G. David Forney (Vice-President, Technical Staff, Informations Systems Group, Motorola) has stated that Motorola intends to make licenses available to applicants, under reasonsable terms and conditions, when patents held by Motorola are technically essential to implementing the Encryption Control Protocol (ECP), a product of the PPPEXT Working Group of the IETF. As you know, we've been working with Motorola on the Compression Control Protocol (CCP) specification which has been submitted to the IESG by the PPPEXT Working Group for consideration as a Proposed Standard, and for which a Last Call has been sent to the IETF. The Encryption Protocol has the exact same status (up for Proposed, Last Call sent). I have written to David Forney thanking Motorola and asking him to confirm that Motorola will provide licenses to applicants implementing EITHER or BOTH specifications. I have also provided a copy of RFC 1602, and noted the section which states that "... agreement on assurances between the owner of rights and ISOC" will be entered into at the time the specification is to be raised to the Proposed Standard level. Both specifications are ready to enter the standards track. I will let you know as soon as I receive confirmation from Motorola, at which time I expect ISOC will take the matter up with Motorola directly.
