What does this have to do with XML 1.1? Or with XML at all?

Where did you get that requirement from?

Anyway, if the language allows textual content (such as comments), it 
should better handle non-ASCII characters. And the simplest way to do 
that is to base it on Unicode, and to require UTF-8 as encoding.
