I do not also well see to introduce this concept of in-context versus out-of context in the standard.
The values in realm and Host OLR reports are stored by the client and used for throttling of future requests. The fact that an OLR is received in a certain type of answer or on another has no impact, its value in both type of answers is relevant.
In practice when the client sends a request with only the realm,  the server, if overloaded will send a host OLR, then the DA having selected the server, has  no particular reason to remove the host OLR which is valuable info. The client will receive both OLR and handles them. So no need to introduce an in-context versus out-of context.
