The status is that he filed it. It doesn't matter whether there are 
viable claims in it.

That opinion matches a search of the IPR database for 
draft-ietf-dnsop-dns-capture-format.

There is no need to "drop this claim" in order to move the draft 
forward. Plenty of documents in the IETF have claims like this 
associated with them.
