All this has actually been addressed by the NTIA (Karen Rose) and 
signed 14 years ago.

This is probably where the confusion introduced by Fiona Alexander comes from.

This is BCP 52. The problem is not with ICANN but with the IETF.
- RFC 3172 section 3 should be reminded to participants, WG Chairs, 
RFC authors, ADs
- RFC 3172 Section 5 to the IAB (e.g. Russ Housley Liaison statement 
of 2014/09/15 - https://datatracker.ietf.org/liaison/1351).
