Well, fixing that misconception is one of the points of this discussion.

After JSON get standardized, people should no longer be able to claim "It is legal in JSON to have duplicate names." with a straight face.  

(It never was, but the requirement was stated with sufficiently soft language that people have simply re-interpreted what was said as something else that happened to be convenient at the time.)
