Absolutely!

That's exactly how I imagined either experimental or vendor extensions to work.  In this case, the question for Henning is whether he wants to implement this using a Data Item in the experimental space until he has a chance to add it to his draft 802.11-DLEP-extensions draft, or use a vendor extension TLV, using his own OUI, documenting and circulating it privately.
