I agree on the concept, the problem is that this is a dynamic 
environment with lots of variables and "tools" deployed in various 
ways to block, intercept, maximize revenue, etc by various parties. 
Thus, I think this is classic example of where the document needs to 
be less specific and more generic along the lines of "...deemed to be 
sufficiently open and of sufficient capacity for normal IETF business 
activities..."
