Remember that we are discussing a view of what the AD's are today!  This 
doesn't mean it is what we should be aiming for

Personally,
- I feel 'arbiter' is a good reflection of the current state of play, 
whether that is what it should be or not, and
-  I would suggest that we should leave off wordsmithing the commentary 
and concentrate on the principles.
