My understanding is that the approach is perfectly fine; see what a receiver is supposed to do in section 12.2. OTOH I agree that servers might be interesting in greasing this feature (by coalescing every 1-RTT packet that the server sends with an invalid long header packet, for small portion of the connections it handles).
