Folks interested in leveraging the hardware H.264 codec support on Windows devices are welcome to check out the Windows Hardware Certification Requirements [1].  Search for "H.264 encoder" once you have opened the pdf.  BTW, the Skype and Lync applications have been using the hw encoders on Win8.1 devices since the Win8.1 release.
