I agree on this point, I was going to send a similar comment

It should be clear in the spec that the endpoint will be able to send data right after having 
sent the SPUD packet with the "open”command, without have to wait a full rtt 
(i.e. the end point should not be forced to wait for the creation acknowledge of a tube to start sending data)

actually it should be stretched to the point to make possible for the end point to star sending data in the same message containing the
SPUD packet with the “open” command
