With all due respect, you're not a lawyer. In particular, you are not one practicing in the area of patents and intellectual property.

Your opinion on this matters as much as mine, or any random bystander walking down the street.  Well, as you're an AD, you have the power to help codify your opinion (in the form of the writeup), but it doesn't mean it is an informed opinion, nor that it is doing the right things to protect the IETF and its RFC's.
