I am not sure it is a MUST as the idea is to try to give some freedom to
the clients to behave "offtrack" of the specs.

As the WHIP servers are not enforced to support receiving that setup active
attribute, they may as well choose to send an "actpass"  and hope that the
server answers with a "passive" (which I think is the common case), and
drop the call if they receive an "active" in the response.

Anyway, no hard feelings about this, I can change to MUST if everyone else
thinks that it is better.
