As I understood the discussion during the BoF, DIEM may have
something of a scoping problem about which agreement is not going to
be easy.  As an example, if you look, e.g., at slide 4 of the third
presentation [1], unless "Wayne Enterprises" is, fictional or not, an
enterprise whose identify is covered by international treaties, it
seems to me it would be at least as much a candidate for a BIMI-type
mark as an DIEM one.  If that is not the case, I still do not
understand BIMI's intended focus and scope.

Similarly, if one reads the summary in  the meeting agenda [2], the
trademark community would certainly claim that those marks enjoy
"protections under a specific law".

So, as I have suggested before on this (BIMI) list and hinted in chat
during DIEM, if the problem statements and scoping are, indeed, very
different, some significant effort may be needed in one or both
groups to define the boundary.  Of course, if DIEM decides, contrary
to the last three presentations as I understood them, that their
scope is limited to International Humanitarian Law or something
equally narrow, then the overlap with BIMI disappears.   Until and
unless such a decision is reached, I'd encourage those interested in
either group to pay attention to what the other one is doing.
