The original example, while slightly weird, is correct as is. The event's DTSTART time is 09:00 New York TIme, and the UNTIL time is 00:00 UTC, which is before this. Therefore you would not get a recurrence on the 7 Oct with this rule and so it would produce 10 occurrences, as specified.
