Hello,

I got zero responses back from the European managers on this one,
so I wonder if any Americans can be bothered....

I have to ask your help on a "little" legal matter.
UNINETT has obtained the right to use the ON-Mail X.400 product.
This is an X.400 implementation based on PP, with an user interface
that runs under MOTIF and X-Windows, and an X manager interface.
I think it looks promising.

We have the right to:

- Use it for UNINETT non-commercial customers
- Distribute it to academic and research customers all over the world
  (binary + PostScript)
- Make it available for anonymous FTP (as long as the distribution
  conditions are made plainly visible)

Now, could you take a look at the following text, and see if:

- you find the conditions reasonable
- you think they make sense in your country's legal context
- you have any other comment

Once we are reasonably certain that the notice says what we want them to,
and is understandable in most legal contexts, I will tell you all about
where to FTP the software and documentation.

Warning: At the moment, the SW and documentation are all in Norwegian.
This will probably be fixed soon, but kind of limits the usefulness of
the product just now :-)

NOTICE REGARDING LICENSE AGREEMENT

ON-Mailis copyrighted, commercial software
which has been made available for use in the academic community
under a license agreement.

ON-Mail - the software - is the property of NOTIS A.S., a 
Norwegian company. The software is copyright 1991-1993 under 
Norwegian copyright law.

Under a license agreement between NOTIS A.S. and Uninett, the
Norwegian Academic Computer Network, ON-Mail has been made
available for use in the
academic community. Users of ON-Mail within the academic
community are bound by the terms of this agreement, unless they
have a direct license agreement with NOTIS A.S.

For the purposes of this agreement, the academic community is
understood to comprise institutions inside and outside Norway
which have research and/or higher education as their primary 
field of activity and operate on a not for profit basis. 
Henceforth, these institutions are called licensed institutions. 

Under this agreement, licensed institutions may use ON-Mail free
of charge subject to the following conditions:

o Within 14 days of acquiring a copy of ON-Mail, a licensed
  institution shall either

  - inform NOTIS A.S. that it has acquired the software and
    undertake to follow the license agreement - including but not
    limited to the disclaimers of warranty and liability printed
    below

  or

  - destroy or return all copies of the software.

o ON-Mail shall not be distributed without this notice.

o ON-Mail shall not be distributed to parties which are not
  licensed to use the software.

o ON-Mail shall not be distributed to parties in countries where a
  Norwegian copyright is not recognized.

o Except where an explicit permission has been obtained from NOTIS
  A.S., ON-Mail shall not be made available on anonymous ftp,
  bulletin boards, or other means of distribution which provide
  easy access to the software to parties which are not licensed to
  use it.

  However, a licensed institution may distribute the software to
  internal users in any manner it sees fit, provided that the
  software is not made easily available to unlicensed parties.

o When distributed free of charge under this agreement, there is
  no warranty for the software, to the extent permitted by
  applicable law. Except when otherwise stated in writing, NOTIS
  A.S. and other copyright holders provide the program "as is"
  without warranty of any kind, either expressed or implied,
  including, but not limited to, the implied warranties of
  merchantability and fitness for any particular purpose.

  In no event unless required by applicable law or agreed to in
  writing will NOTIS A.S. or any other copyright holder be liable
  for damages, including any general, special, incidental or
  consequential damages arising out of the use or inability to use
  the software (including but not limited to loss of data or data
  being rendered inaccurate or losses sustained by you or third
  parties or a failure of the program to operate with any other
  programs), even if such holder has been advised of the
  possibility of such damages.

o The license agreement is subject to the laws of the Kingdom of
  Norway.


For a fee, NOTIS A.S. will provide support for ON-Mail.
