Stephen, we added the text "and recognizing that analysis of antitrust 
considerations will be different for differently-positioned 
participants" to try to address your concern about different roles.  If 
we water it down much more, it ceases to be a useful warning for the 
many IETF participants who do need this perspective.  And we are trying 
to be clear (thus red vs yellow) about there being different degreees of 
risk associated with different aspects.

I am having trouble seeing how to meet the needs I see with the concern 
you have for your particular case.  (It is not even all academics, since 
many academic institutions also engage in profitable business / 
licensing / ...)
