In this particular case, it appears that patent application was filed in the US on 2021-11-24 and disclosed on 2021-11-26. However, there was a pre-dating Chinese patent that was applied for on 2018-06-06. I have no access to whether the authors of the document or the active participants in the WG would have had reason to know about the Chinese patent. That should not detract from the point you want to discuss. There was an IPR disclosure after the Last Call, in addition to the two disclosures which were filed before that. It is not possible for the working group to evaluate alternative solutions (Section 5.2 of RFC 8179) when an IPR disclosure is filed this late in the process. Is this another case of too late to fix?
