Understood.  The WG discussed how to handle this situation -- https://mailarchive.ietf.org/arch/msg/rats/3nCTOkNYW8ydEo0zHZlQoY8F92A/.  Ultimately, they decided to proceed with publication in spite of these IPR claims.
