Granted, that’s just over 20%.

IP protocol numbers are one of the most scarce of popularly used codepoints, running over 50% assigned.

Transport ports are running somewhere around 12%, and we also treat them as a limited resource. So scarcity is relative. 

However, we’ve assigned 3 in the past 6 years (not counting this), and nearly every time the request started by asking for more than . As you note, there isn’t any risk of running out because we also recognize that every assignment becomes a potential argument for precedence for future assignments. This is why we treat them as scarce.
