I would not be averse to saying that the use of GAL should be 
negotiated, but it is not required by the MPLS architecture.

The GAL is a reserved label, so the LSE parser should find it and punt 
the packet to the reserved label handler. However the PW should also 
co-ordinate the VCCV type between the two ends and thus GAL would become 
VCCV type 4.
