The reason the second bit was fixed to 1 in QUICv1 was to allow multiplexing with other protocols. Greasing it would defeat that and would cause problems with some Google servers that use it for demultiplexing. Given that these demultiplexing concerns are unlikely to go away, it does make sense to add it to the invariants.
