Thanks for this clarification - agreed.   Without any specific rules, if conceptually one thinks about ARP and ND and deems the default is off-link, then the decisions are very simple.  The algorithm for either ipv4 or ipv6 is deterministic in that if the algorithm cannot make a clear on-link determination, the algorithm defaults to off-link which implies sending traffic to the default router(s).  Only when clear indication of on-link exists, an address resolution NS is issued.
