Fully agree, I don't understand this either.
Obviously, the patent application was filed in 2006 already.
Looking at:
http://tools.ietf.org/id/draft-shen-nsis-tunnel-02.txt:
the usual boilerplate says:
   By submitting this Internet-Draft, each author represents that any
   applicable patent or other IPR claims of which he or she is aware
   have been or will be disclosed, and any of which he or she becomes
   aware will be disclosed, in accordance with Section 6 of BCP 79.

see also section 6.2 of RFC 3979, which has not been followed...
