I think that the IETF should not go down the road of making judgements about specific countries and their policies, but rather stick to the basic principle of sovereignty, which has kept the world together for the last few centuries: each country has the right to determine the rules for its own citizens, and each citizen has the right to live (and access the Internet) under their own country's rules and not under some other country's ones.

So it is a reasonable concern for non-US citizens to be worried about their data going to the US, independently from whether their own laws are better or worse than those of the US.
