Sure. Because we have always been able to assume that the reason for the TM
is to be able to fend off misuse by the International Association for
Naughty Advertising or whatever, and because ICANN has always behaved
sensibly about the TM. What we seem to be discussing now is a future in
which the TM holder doesn't behave sensibly.
